              5        Common Pleas Court Case No. 950,197, on
              6        the docket of Judge James P. Kilbane,
              7        titled Donald Gardiner, ot al, versus
              8        St. Luke's Hospital, et al.
              9                We are here today for  purposes  of
              10       obtaining the sworn deposition of
              11       Dr. Irwin Frank, who has been given to the
              12       Defendants in this case an an expert on
              13       behalf of the Plaintiff; that  all  parties
              14       are in attendance and of record,  and  that
              16       this deposition was set up pursuant to
              16       agreement; is that right, Mr. Weisman?
