D E P O S I T I O N

		The deposition of TYLER KRESS, Ph.D., taken by
 	the defendant for the purpose of discovery, pursuant
 	to Tennessee Rules of Civil Procedure, by agreement
 	of the parties, on November 19, 2003, in the office
 	of STATE ATTORNEY GENERAL, 617 Cumberland Avenue,
 	Knoxville, Tennessee, was taken before Cheryl M. 
 	St. Germain, CCR, a Notary Public at Large for the
 	State of Tennessee.
		It is agreed that the deposition may be taken in
     machine shorthand by Cheryl M. St. Germain, Court
Reporter and Notary Public, that she may swear the 
witness and thereafter transcribe her notes to 
typewriting and may present the transcript to the
witness to read and sign thereto, that all objections
will be reserved except as to the form of the
question or the responsiveness of the answer, and
that all formalities touching caption, certificate,
filing, transmission, etc., are expressly waived.
