         2   show that this  is the deposition of Joel
         3   Bennett, M.D.,  who has been identified as
         4   one of plaintiff's experts in the case of
         s   Mary Rummer, et cetera, plaintiffs, versus
         6   Kaiser Health Plan, Incorporated, et. al,
         7   defendants, in Case No. 204571 in  the  Court
         8   of Common Pleas, Cuyahoga County, Ohio.
         9                   Let the record further show
        10   this deposition is being taken upon
        11   cross-examination and pursuant to notice
        12   and also agreement of all counsel; is that
        13   correct?
        14                   MR. FULTON:  Absolutely
        15   agreed.
