     5            It is stipulated by and between
     6  counsel for the respective parties that  the
     7  deposition of SETH KANTOR, M.D., a  Witness
     B  herein, called by the Plaintiffs for
     9  cross-examination under the statute, may  be
   10   taken at this time by the Notary, by agreement
   11   of counsel without notice or other legal
   12   formality; that said deposition may be reduced
   13   to writing in stenotypy by the Notary, whose
   14   notes may thereafter be transcribed out of the
   15   presence of the witness; that proof of  the
   16   official character and qualification of  the
   17   Notary is waived; that the signature of  the
   18   said SETH KANTOR, M.D. to the transcript  of
   19   the deposition is expressly waived by counsel
   20   and the witness; said deposition to have the
   21   same force and effect as though signed by the
   22   said SETH KANTOR, M.D.

     1           MR. ANTOGNOLI:  This is the
     2   deposition of Dr. Seth Kantor being taken by
     3   agreement between the parties in the case of
     4   Nichols versus Family Medi-Center, et al., now
     5   pending in the Scioto County Court of Common
     6   P I e a s .
     7            As I mentioned, this is being taken
     8   pursuant to agreement between the parties.
     9   I'm assuming that all the usual stipulations
     10  concerning any defects in notice,
     11  qualifications of our court reporter, et
     12  cetera, can be entered into; is that correct?
     13           MR. DEVER:  That's right.
     14           MR. ANTOGNOLI:  Thank you.

     17  by me first duly sworn, as hereinafter
     18  certified, deposes and says as follows:

     21  Q.        Doctor, my name is Bennie Antognoli.
     22  I'm an attorney in Cleveland, and I represent
     23  a gentleman by the name of William Nichols
     24  from Portsmouth, Ohio.
