        1           ORAL ANSWERS and DEPOSITION of the
        2  witness, ROBERT A. deLEMOS, M.D., who resides in
        3  San Antonio, Bexar County, Texas, in answer to
        4  questions propounded in the above entitled and
        5  numbered cause, taken on behalf of the Plaintiff,
        6  James Peskin, before DEANNE SMITH, Certified
        7  Shorthand Reporter in and for the State of  Texas,  on
        8  January 7, 1991, between the hours of 10:00 a.rn.  and
        9  1:45 p.m., at the Southwest  Foundation  for  Research
        10 and Development, 7620 NW Loop 410, San Antonio,
        11 Texas, Bexar County, Texas, pursuant to due Notice
        12 and under the following agreement of counsel.
        13           It is stipulated and agreed by  and  between
        14 counsel and the respective parties hereto that the
        15 deposition of the witness named in the caption
        16 hereto may be taken at this time and  place,  pursuant
        17 to due Notice, and that the said  deposition,  or  any
        18 part thereof, when so taken may be used on  the  trial
        19 of this case the same as if the witness  were  present
        20 in Court and testifying in person.
        21           It is furtber stipulated and agreed  by  and
        22 between counsel and the respective parties hereto
        23 that the necessity for preserving  objections  to  the
        24 questions propounded or to the answers  given  at  the
