       13 MD, a witness herein, may be taken at this time by the

       14 plaintiff as upon direct examination and pursuant to the

       15 Ohio Rules of Civil Procedure, all other legal formalities

       16 being waived by agreement; that the deposition may be

       17 recorded by audiovisual means; that the deposition may be

       18 taken in stenotypy by the notary public-court reporter and

       19 transcribed by her out of the presence of the witness; that

       20 the notary public-court reporter may swear the witness as if

       21 such swearing were done in her jurisdiction; that the

       22 submission of the transcribed deposition to the witness for

       23 hiB examination and signature is expressly waived
