Your acceptance of the following terms allows you to upload to www.crossexam.com (the “Site”) transcripts of expert witness testimony and to receive credits that allow you to download expert witness transcripts from CrossExam.com.

For each expert witness testimony transcript that you upload to the Site and that is accepted for listing on the Site, you will receive a credit that allows you to download another expert witness transcript from the Site.

By uploading a transcript to the Site, you grant to CrossExam, LLC a perpetual, royalty-free license to list the transcript on the Site. You agree to not donate, sell, distribute or upload to any other website (including any website over which you have direct or indirect ownership, control or affiliation) any of the transcripts that you upload to or download from CrossExam.com. You agree that the credits you receive from uploads of your transcripts through the Site represent adequate consideration for the license you grant to CrossExam, LLC.

You acknowledge and agree that we reserve the right to reject any submitted transcript based on our own listing criteria and to remove from the Site any previously submitted and approved transcript. We reserve the right at all times to edit, refuse to post, or to remove any information or materials posted on the Site.

You acknowledge and agree that your account with us is for a single user and that you may NOT give your user information to anyone else. It is your responsibility to keep your password private from other individuals. Any misuse of an account will lead to immediate termination of your account.

We reserve the right to make improvements or changes in the information, services, products, and other materials on the Site, or terminate the Site, at any time without notice. We may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement. Accordingly, you agree to review this Agreement periodically, and your continued access or use of this site shall be deemed your acceptance of the modified Agreement.

We are not responsible for unavailability of the Site due to factors beyond our control, including (but not limited to) acts of God, technical or system problems, acts of war, or acts of terrorism. In addition, we are not responsible for your inability to access the Site website due to problems with respect to your ISP or any equipment that you may chose to utilize in accessing the Site.

You agree that any disputes related to the Site or this Agreement or any transcripts that you have uploaded to the Site shall be resolved exclusively by binding arbitration under the terms and rules of the American Arbitration Association, such arbitration to be held in Cleveland, Ohio.
